Administrative penalties for chemical violations: Decree 275/2026/ND-CP

Alongside the new framework of Law No. 69/2025/QH15, the penalty regime has been rewritten. Decree No. 275/2026/ND-CP governs administrative penalties in the chemicals and industrial explosives sector. It was issued on 8 July 2026, took effect on 25 August 2026, and replaces Decree 71/2019/ND-CP.

Maximum fines

Individual — chemicals	VND 50 million per act
Individual — industrial explosives	VND 100 million
Organisation	Twice the individual fine for the same act

The principal forms of penalty are a warning and a fine.

New: green chemistry principles

According to the sources, the Decree for the first time penalises breaches of the green chemistry principles: each principle not applied may attract VND 15–20 million for an individual.

The green chemistry principles for technology design and selection are set out in Article 11 of Decree No. 25/2026/ND-CP.

Commonly cited categories of violation

• Failing to comply with safety rules in chemical activities;
• Operating without a licence for chemicals requiring special control;
• Failing to make the imported chemical declaration;
• Workshops and warehouses not meeting national standards and technical regulations, or not suited to the properties, scale and technology.
