A “safe” chemical warehouse is not a feeling; it is a checkable list of obligations. Here is what Law on Chemicals No. 69/2025/QH15 requires.
1. At the storage location (clause 1 of Article 14)
- The necessary warning information where hazardous chemicals are stored;
- Internal rules on chemical safety;
- A signage system matching the level of hazard. Where a chemical has several hazardous properties, the warning pictograms must show all of them;
- Incident response equipment and means suited to the hazardous properties of the chemicals.
2. People (Article 33)
- Technical facilities meeting the chemical safety and security requirements (clause 1);
- A person responsible for chemical safety with appropriate qualifications (clause 2);
- Workers involved must receive chemical safety training and be issued personal protective equipment suited to their assigned duties (clause 3).
Clauses 2 and 3 do not apply to the use of chemicals for essential consumer and household needs (clause 4 of Article 33).
3. Maintained, not achieved once (Article 34)
- Maintain chemical safety and security conditions throughout operations;
- Periodically inspect, maintain, repair and verify the machinery and equipment operating the safety and waste treatment systems, and the vehicles, as required by law.
4. Safe distance (Article 35)
Safe distance is the distance to be maintained from a chemical facility to residential areas, public works, defence works, military zones, security works, historical and cultural relics, scenic landscapes, nature reserves and areas where domestic water is taken (clause 1).
- A chemical facility must meet the safe distance set by the relevant technical regulation (clause 2);
- No housing or other works may be built within the safe distance, except specialised works prescribed by the Government (clause 3);
- The provincial People’s Committee issues a roadmap for existing chemical facilities that do not meet the safe distance (clause 4).
5. On-site response capability (Article 40)
Organisations and individuals in chemical activities must ensure sufficient on-site response equipment and personnel and invest in response equipment matching the scale and hazardous properties of the chemicals, in line with the approved Plan or the issued Measures (clause 1).
