Measures (Biện pháp) need no approval, but that does not make them free form. Article 35 of Decree No. 25/2026/ND-CP lists what they must contain.
Who must build them (clause 1)
- Organisations and individuals storing hazardous chemicals not covered by clause 2 of Article 33 — they must build the Measures and issue them by decision before the facility formally starts operating;
- Organisations and individuals transporting hazardous chemicals — they must build Measures for transport and carry them during carriage;
- ★ The storing party must update the Measures to the national database within 30 days of issuance.
The five mandatory contents (clause 2)
- Identify and delimit the points at high risk of a chemical incident, and set a plan for regular inspection of them;
- Prevention measures, and measures for storage that avoids loss of chemicals;
- The on-site measures, equipment and response force;
- The scenarios and situations of a chemical incident and the plan for handling each;
- The plan for coordinating with external forces.
These five headings are also the skeleton of a drill. If the fourth is written in generalities, there is no scenario to run.
How it connects to other duties
- The issued contents must be fully implemented (clause 1 of Article 39 of the Law);
- On expansion of scale or change of line or equipment they must be amended, and the changed items may only operate after issuance (clause 2 of Article 39);
- A civil-sector facility storing chemicals on the clause 2 Article 37 list must also run an annual drill (clause 3 of Article 39).
