A self-check list before starting a chemical business in Vietnam

The list below does not replace a legal file, but if any answer is “not sure yet”, that is the thing to do first.

1. Which group do your chemicals fall into?

Conditional, requiring special control, or banned — under Article 9 and the lists in Decree 24/2026/ND-CP. Everything else follows from this answer.

2. What paperwork, issued by whom?

Conditional → a certificate from the provincial People’s Committee. Special control → a licence from a ministry. Both run five years (Article 11).

3. Might you be exempt?

A mixture classified as hazardous at a low level, or decanting and blending that serves your own internal production — see Article 18.

4. Do you have a chemical safety officer?

Mandatory, with appropriate qualifications (clause 2 of Article 33). Workers involved must be trained and equipped (clause 3 of Article 33, Article 36).

5. Where will the chemicals sit?

Your own warehouse, or the service of a holder of the Certificate of eligibility for chemical storage service? (clauses 2 and 3 of Article 14 — that certificate requirement takes effect on 1 July 2026).

6. Are the safety data sheets ready?

Producers and importers prepare them; sellers supply them; buyers must request them and keep them at the storage location (Article 25). The template is in Appendix I of Circular 01/2026/TT-BCT.

7. Are classification and labels GHS-based?

Producers and importers are responsible for the classification result and the label information (Article 23).

8. Plan or Measures?

On the list and above the threshold in clause 2 of Article 37 → a Plan, approved before you may store. Otherwise → Measures, issued before you may store (Articles 37, 38). Transport needs its own Measures, carried on the vehicle.
